Use of the website operated by Sneaker Politics, LLC and its affiliates (collectively, “Politics,” “we,” “us,” “our”) with home page located at https://sneakerpolitics.mom/, any related apps that we may provide, together with all products and services we may offer from time to time via our website and/or related apps, our related social media sites and pages (for example, on Instagram, X, and Facebook), or otherwise through your interactions with us (the website, apps, products, services, and social media pages, collectively, the “Services”) are subject to the terms and conditions stated herein, including without limitation the SMS Terms set forth in Annex A, which are incorporated herein (collectively, the “Terms and Conditions”).
Your use of the Services through Apple iOS mobile application software is subject to the additional terms set forth in Annex B, which are incorporated herein. Your use of the Services through our Android mobile application software is subject to the additional terms set forth in Annex C, which are incorporated herein.
If you enroll or participate in our VIP Club loyalty program, your participation is also subject to the additional VIP Club terms set forth in Section 9, which are incorporated herein.
By your use of the Services you agree to these Terms and Conditions, and you certify that you are 18 years old or older and are able and competent to give Politics rights as detailed in these Terms and Conditions and to comply with these Terms and Conditions. The Services are not intended for individuals under the age of 18.
Politics reserves the right to refuse service and/or prohibit or terminate access to the Services, in whole or in part, for any or no reason, at any time in its sole discretion, with or without notice to you. Further, your breach of these Terms and Conditions may jeopardize your continued use of the Services and may result in the cancellation of your order(s), among other consequences.
THE USE OF ANY ROBOT, SPIDER, OR OTHER AUTOMATIC DEVICE OR SOFTWARE IN CONNECTION WITH THE SERVICES IS STRICTLY PROHIBITED. IN THE EVENT WE REASONABLY DETERMINE THAT ANY ORDER OR ATTEMPTED ORDER WAS MADE BY OR THROUGH USE OF ANY ROBOT OR OTHER AUTOMATIC DEVICE OR SOFTWARE, WE HAVE THE RIGHT, IN OUR SOLE AND ABSOLUTE DISCRETION, TO DENY OR CANCEL ANY SUCH ORDER, TO REFUSE TO ACCEPT ANY RETURNS OR OFFER REFUNDS, AND/OR TO CHARGE RESTOCKING FEES.
BY USING THE SERVICES, YOU AGREE TO ARBITRATE DISPUTES AGAINST POLITICS IN YOUR INDIVIDUAL CAPACITY IN ACCORDANCE WITH SECTION 25 (“Dispute Resolution and Governing Law”) BELOW AND YOU ARE WAIVING YOUR RIGHT TO ACT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
BY CLICKING “I AGREE” (OR A SIMILAR BUTTON OR CHECKBOX) OR BY PLACING AN ORDER THROUGH THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES OR PLACE AN ORDER.
1. Modifications to These Terms and Conditions. Politics reserves the right, at any time and without notice, to add to, change, update, or modify these Terms and Conditions simply by posting such addition, change, update, or modification on the Services. Any such change, update, or modification will be effective immediately upon posting on the Services, as of the “Last Updated” date above. We suggest that you check these Terms and Conditions periodically for changes. Your continued use of the Services after any such change constitutes your acceptance of the revised Terms and Conditions.
2. Your Privacy. To understand how we collect, use, and safeguard the information you may provide to us via the Services, including personal information, please review our Privacy Policy, which is incorporated into these Terms and Conditions by reference.
3. Your Account. If you create an account on the Services, you are responsible for maintaining the confidentiality of your account information and password, and for protecting and restricting access to such information. You understand and agree that you are responsible for all activities that occur using your account or password, whether or not you authorized such activity. Politics reserves the right, in its sole discretion and without notice to you, to terminate your account and/or to restrict access to all or part of the Services for any reason, including, without limitation, for extended periods of inactivity.
4. Product Descriptions. Politics endeavors to be accurate when describing and displaying products on the Services. However, items may occasionally be mispriced, described inaccurately, or unavailable (for example, due to delays with respect to updating the Services or our advertising on other websites). Certain weights, measures, and similar descriptions are approximate and are provided for convenience purposes only, and fit and sizing may vary between brands, products, and even the same or similar products. The particular technical specifications and settings of your device and its display could affect the accuracy of its display of the colors of products offered on the Services. As a result, and as set forth in Section 19 (“Disclaimers”) below, Politics does not and cannot guarantee the accuracy, reliability, currency, or completeness of the information on the Services, including prices, product images, descriptions, specifications, and indications of availability. Politics reserves the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
5. Pricing and Payment. The price for all goods will be as quoted on the Services. The prices displayed on the Services are quoted in U.S. dollars. Prices and availability information are subject to change without notice. Prices are exclusive of applicable sales or use tax and delivery costs, both of which you agree to pay upon ordering. Any applicable sales or use tax is calculated based on your shipping destination and applicable law, is itemized in your cart and order confirmation, and is your responsibility, along with all other applicable federal, state, and local taxes associated with your order.
The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will apply only to orders placed after such changes take effect. You represent and warrant that (a) any payment information you supply to us is true, correct, and complete; (b) you are duly authorized to use the designated payment method for the purchase; (c) charges incurred by you will be honored by your payment provider; and (d) you will pay charges incurred by you at the posted prices, including all applicable taxes and shipping and handling charges.
Payment options such as Paypal and Apple Pay may be disabled for certain high-traffic releases to ensure that inventory integrity can be maintained.
6. Order Acceptance. All orders placed by you are subject to acceptance by Politics, and all items are subject to availability. You agree that your order is an offer to buy, under these Terms and Conditions, all products and services listed in your order.
Acknowledgement of your order means that Politics has received your order request; it does not mean that your order has been accepted or shipped, or that the price or availability of an item has been confirmed. Politics may in its discretion require additional verification or information before accepting any order.
Politics reserves the right, without prior notice and in its sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include, but are not limited to: invalid, incomplete, improper, or missing payment or shipping information; limitations on quantities available for purchase; inaccuracies or errors in product or pricing information; use of any robot, spider, or other automatic device, software, process, or application to place, or take preparatory steps to place, one or more orders; violation of these Terms and Conditions; or actual or suspected fraud or abuse.
Politics will verify the availability and price of an item before it is shipped. If an item’s correct price is lower than the stated price, Politics will charge the lower amount and ship you the item. If an item’s correct price is higher than the stated price, if the item is no longer available, or if Politics determines that there were inaccuracies in the product information, Politics may cancel your order and notify you of such cancellation via email.
Order Cancellation. If you need to cancel your order, please contact us as soon as possible before it ships through our online chat service. For more information, please visit our Help Center. If your order has not yet been processed or shipped, we will do our best to cancel it and issue a refund to your original payment method.
Please note that our fulfillment team moves quickly. Once an order is placed, it may go straight into processing, so we cannot guarantee that a cancellation request can be honored.
Once an order has been processed or shipped, it is no longer eligible for cancellation. After your order is delivered, you may submit a return request through our Help Center, subject to the Return/Exchange Policy in Section 10.
7. Limited Release – Purchase Limitation. In an effort to allow fairness for all customers, limited and/or special release products may be subject to quantity limits per customer, unless otherwise specified in the product description. Please note that multiple orders submitted under the same address may be canceled. Abusive behavior will not be tolerated. Should this pattern continue, your account may be subject to review, and possible suspension or termination, by our fraud analysis team. Please feel free to reach out through our online chat service if you feel as though your order was canceled in error.
8. Promotions, Discount Codes, and Gift Cards. We may, from time to time, offer promotions, discounts, promotional codes, or coupons that may be governed by additional terms and conditions separate from these Terms and Conditions. If there is a conflict between the terms of a promotion and these Terms and Conditions, the promotion terms will govern. Unless otherwise stated, promotional codes are for one-time use by the intended recipient only; may not be combined with other offers; are not transferable, redeemable for cash, or valid on prior purchases; and may be modified or canceled by us at any time. We reserve the right to cancel any order and/or void any promotional benefit where we reasonably determine the promotion has been obtained through error, fraud, or abuse.
Gift cards and store credit are subject to the terms presented at the time of issuance and applicable law. Gift cards have no fee and, except as required by law, no expiration date; are redeemable only through the Services and/or our retail locations; are not redeemable for cash except where required by law; and will not be replaced if lost, stolen, or used without authorization.
9. VIP Club Loyalty Program. The VIP Club is Politics’s optional, free loyalty program, offered in our sole discretion for personal, non-commercial use and void where prohibited. By enrolling, you agree to these VIP Club terms, which are part of these Terms and Conditions and control over them as to the program. You must be at least 18, a legal resident of the United States, and have a valid Politics account; one membership per person.
Earning points. You earn points as shown below. Purchase points are credited after the order ships and the return window passes, and are earned only on the net price of eligible merchandise — not on tax, shipping, fees, gift cards, prior orders, amounts paid with rewards/store credit, or certain excluded or third-party-branded products.

Points terms. Points and rewards have no cash value, are not property, are non-transferable, and are a revocable license; Politics determines all balances. Points expire one (1) year from the date they are earned. Points from any order that is canceled, returned, refunded, or charged back are reversed, and we may recover the value of any reward already used.
Changes; termination; taxes. We may modify or discontinue the program, its earn rates, tiers, benefits, redemption values, and rules at any time in our sole discretion, effective on posting, except where advance notice is required by law. You may cancel anytime; we may suspend or terminate your membership and forfeit points for fraud, abuse, or violation of these Terms. On termination of your membership or the program, unredeemed points and rewards are forfeited except where prohibited by law. You are responsible for any taxes arising from your participation. The program is otherwise subject to all provisions of these Terms and Conditions, including the disclaimers, limitations of liability, and dispute-resolution provisions.
10. Risk of Loss. All purchases through the Services are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon Politics’s delivery of such items to the shipping carrier. Except as expressly set forth in these Terms and Conditions, you are responsible for filing any claims with the applicable carrier for damaged and/or lost shipments.
11. Shipping and Returns/Exchanges. Shipping and Delivery. We will arrange for shipment of the products to you. Please review the available delivery options and any applicable shipping charges at checkout. You will be responsible for any applicable shipping charges as specified during the ordering process.
Please allow 72 hours for order processing and verification. Once shipped, delivery within the continental U.S. typically takes an additional 3–7 business days, depending on the destination.
Please note that order processing and delivery times may be longer during sale events, product releases, holidays, and other peak periods, and may also be affected by circumstances beyond our reasonable control (see Section 24, “Force Majeure”). All processing, shipping, and delivery dates and timeframes are estimates only and are not guaranteed. We are not liable for any delays in processing, shipment, or delivery.
To protect our customers, Politics is unable to change or intercept the shipping address of a package to alter its delivery, and Politics will only ship to the address provided at checkout, which must match the billing address. Due to our fraud-protection policy, all online orders are required to have identical billing and shipping addresses. To minimize fraudulent transactions, any orders with different shipping and billing addresses may not be processed. We are unable to combine shipping on multiple orders.
Lost or Stolen Package. If your package is marked as delivered but you have not received it, please first check with neighbors, building staff, or around your delivery location, and review any available security or doorbell camera footage, as this often helps locate the package.
As stated above and in these Terms and Conditions, risk of loss and title pass to you upon our delivery of the products to the carrier, and Politics is not responsible for packages once they have left our facility, including any lost or stolen shipments. Please file a claim directly with the applicable shipping provider using your tracking number.
If the carrier requires additional information from us to support your claim, contact our team through our online chat service, available at the bottom of the screen on our website, and we will assist where possible. Responding promptly to the carrier's inquiries can also help resolve the issue more quickly.
Lost/Non-Issued Original Packaging Contents. Politics is not responsible for any missing accessories within a footwear or other product that are to be provided by the original manufacturer, such as (but not limited to) spare shoelaces, original tissue paper, hangtags, shoe trees/horns, and similar items. Politics is not responsible for issues relating to original manufacturer boxes delivered with slight and/or significant imperfections, and we do not provide any form of reimbursement for this matter. Should your purchase not contain such item(s), please contact the manufacturer of the product for further support.
Return/Exchange Policy. ALL RETURNS ARE REFUNDED AS STORE CREDIT ONLY (IN THE FORM OF A GIFT CARD). WE DO NOT ISSUE CASH REFUNDS OR REFUNDS TO YOUR ORIGINAL PAYMENT METHOD FOR RETURNS, EXCEPT FOR DEFECTIVE OR INCORRECT MERCHANDISE OR WHERE REQUIRED BY LAW. FINAL SALE ITEMS ARE NEITHER RETURNABLE NOR REFUNDABLE.
For your convenience, Politics accepts returns of eligible products within 15 days of the delivery date. Certain products are non-returnable, including Final Sale items, clearance items, and certain release products (collectively, “Non-Returnable Items”), as further described below. No returns, exchanges, or refunds are available for Non-Returnable Items.
“Final Sale Items” are non-returnable and non-refundable and include: socks, underwear, sunglasses, clearance items, and release products. In addition, any item that is discounted more than 40% off is a Final Sale Item, whether that discount is reached at once or by combining discounts. For example, an item marked down 35% that then receives an additional 10% off (for a total discount of more than 40%) is a Final Sale Item. “Clearance” items are items discounted more than 40% off.
To make a return, visit our Return Portal through our Help Center, enter the email or phone number used for your order, and follow the instructions. The product must be unused and in its original condition with all tags attached, and any footwear must be returned in its original box. RETURNS OR EXCHANGES WITHOUT PROPER DOCUMENTATION, PACKAGING, AND/OR MATERIALS CANNOT BE ACCOMMODATED. IN ADDITION, IF WE REASONABLY DETERMINE THAT A PURCHASED PRODUCT THAT MIGHT OTHERWISE BE ELIGIBLE FOR RETURN WAS ORDERED THROUGH THE USE OF A ROBOT OR OTHER AUTOMATIC DEVICE OR SOFTWARE, WE RESERVE THE RIGHT, IN OUR SOLE AND ABSOLUTE DISCRETION, TO REFUSE ANY SUCH RETURN, TO REFUSE TO OFFER ANY REFUND, AND/OR TO CHARGE A RESTOCKING FEE.
You are responsible for the cost of return shipping. A return shipping label will be generated upon request through the Return Portal, and the cost of that label will be deducted from your store credit or otherwise paid by you, except where the return results from an error on our part or a defective or incorrect item as described below. You bear the risk of loss for items during return shipment until they are received by us.
For eligible returns, Politics issues store credit only, in the form of a gift card, equal to the amount paid for the item(s) returned, less return shipping costs. We do not provide refunds to your original payment method for returns, except for defective or incorrect merchandise as described below. Original shipping costs are non-refundable. Store credit does not expire except as required by law and may be used both on the Services and at our brick-and-mortar retail locations.
Defective or Incorrect Merchandise. In the event of an error on our part — for example, you received incorrect merchandise, or an item is deemed defective — Politics will cover the return shipping cost and refund your payment to your original payment method. Any defective or incorrect item must be reported to Politics within 15 days of the delivery date. Please follow the same return process described above (through our Return Portal through our Help Center) to return defective or incorrect orders. For manufacturing flaws that appear with use (for example, a broken strap, torn heel tab, or loose stitching after wear), please contact the manufacturer directly to open a warranty or damaged-product claim. Politics does not accept worn or damaged products as returns, except where the item was defective or incorrect as described in this paragraph.
12. Manufacturer’s Warranty; Disclaimer of Warranties. We do not manufacture or control any of the products offered on the Services. The availability of a product through the Services does not indicate any affiliation with or endorsement of the product or its manufacturer. Accordingly, we do not provide any warranties with respect to the products offered on the Services. However, products offered on the Services may be covered by the manufacturer’s warranty as detailed in the product description or included with the product. To obtain warranty service for defective products, please follow the instructions included in the manufacturer’s warranty.
ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS,” AND, TO THE FULLEST EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTIES WHATSOEVER WITH RESPECT TO SUCH PRODUCTS, INCLUDING, WITHOUT LIMITATION, ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OR (C) WARRANTY AGAINST INFRINGEMENT OF THE INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU. YOU AFFIRM THAT WE SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY BREACH-OF-WARRANTY CLAIMS OR FOR ANY DAMAGES ARISING OUT OF A MANUFACTURER’S FAILURE TO HONOR ITS WARRANTY OBLIGATIONS TO YOU. NOTHING IN THESE TERMS DISCLAIMS, EXCLUDES, OR LIMITS ANY IMPLIED WARRANTY, RIGHT, OR REMEDY THAT THE LAW OF YOUR STATE DOES NOT PERMIT TO BE DISCLAIMED, EXCLUDED, OR LIMITED. WHERE AN IMPLIED WARRANTY CANNOT BE DISCLAIMED, IT IS LIMITED IN DURATION AND REMEDY TO THE FULLEST EXTENT PERMITTED BY THAT LAW. WE RETAIN OUR RIGHTS OF INDEMNITY AND RECOURSE AGAINST THE MANUFACTURER.
Notwithstanding the foregoing, Politics-branded apparel purchased through the Services that are defective may be eligible for a replacement of the same item or, if a replacement is unavailable, a refund, provided that you notify us of the defect within 15 days of delivery. This exception applies only to apparel branded solely by Politics and does not apply to collaboration products created or manufactured in partnership with another manufacturer or brand. Requests must be submitted through our Help Center and may be subject to verification of the claimed defect.
13. License for Personal Use. Subject to these Terms and Conditions, you are hereby granted a personal, non-exclusive, revocable, non-transferable license to use the Services and view the content, functionality, software, information, data, products, and materials contained, described, referenced, or available on the Services (collectively, “Materials”) for your personal and non-commercial purposes. Neither title nor intellectual property rights are transferred to you, but remain with Politics, who, along with its licensors, is the exclusive owner of all rights, title, and interest therein. Except as otherwise expressly provided, all rights are reserved to Politics.
In connection with this license, you may download Materials, provided that you do not modify or alter the Materials in any way, nor delete, obscure, or change any copyright, trademark, or other intellectual property notice therein.
You may include a link to our home page at https://sneakerpolitics.mom/ on one or more other websites operated by you, provided such websites link to the home page only and you are not linking from any site or service that violates any of the Restrictions on Use in Section 13 below or that is or contains Malicious Code (as defined below) and/or content that is disparaging, abusive, harassing, illegal, discriminatory, fraudulent, or that violates the intellectual property, privacy, or other rights of Politics or any person or entity. Linking to other content within the Services is prohibited without Politics’s prior express written consent. This limited license expressly prohibits the framing of Politics content in any way, or any other activity that may confuse, misdirect, or misrepresent with respect to sponsorship or affiliation.
14. Restrictions on Use. You agree that you shall not: a) Copy, reproduce, modify, use, republish, upload, post, transmit, sell, resell, license, rent, lease, lend, otherwise distribute or commercially exploit in any way, decompile, reverse engineer, disassemble, otherwise attempt to derive source code from, or create derivative works based on, the Services or any Materials obtained from or through the Services; b) “Frame” or use the Services or any Materials in any way that might confuse, misdirect, or misrepresent their source, or sponsorship or affiliation thereof or therewith; c) Use any robot, spider, or other automatic device, manual process, application, or data mining or extraction tool to access, monitor, copy, or use the Services or any Materials, interfere with product inventory or availability, or place or take preparatory steps to place orders for products, goods, or services; d) Take any action that imposes an unreasonable or disproportionately large load on the Services; e) Take any action in connection with your use of the Services or Materials that violates any applicable local, state, national, or international law, rule, regulation, or court order; or f) Otherwise use the Services for any unlawful or abusive purposes, including, but not limited to, the violation of any intellectual property rights (whether belonging to Politics or third parties) and the posting or distribution of any “harmful” or “malicious” code or programming devices (for example, viruses, malware, ransomware, corrupted files, key locks, back doors, trap doors, timers, or other disabling devices) or any other similar software or programs that may adversely affect the operation of the Services or any other software, hardware, network, or other technology (collectively, “Malicious Code”).
FINALLY, DO NOT USE THE SERVICES WHILE OPERATING A MOTORIZED VEHICLE OR WALKING. SUCH USE MAY DISTRACT YOU, MAY CREATE A HAZARD FOR YOU OR OTHERS, AND IS ILLEGAL IN MANY AREAS.
15. Proprietary Materials. All Services and Materials, any improvements or modifications to such Services and Materials, any derivative works based thereon, and the collection, arrangement, and assembly of all such Services and Materials are, except as otherwise expressly stated herein, owned exclusively by Politics or its licensors, and Politics (and, as applicable, its licensors) reserve all rights therein. The contents of the Services and Materials are protected by United States and worldwide copyright and intellectual property laws and treaty provisions. The trademarks, service marks, trade names, logos, and other identifiers used in or in connection with the Services and Materials are the proprietary service marks or trademarks of Politics, its licensors, or third parties, and are protected in the United States and internationally. No copying, modification, or use of any of these marks or identifiers may be made without the prior written authorization of Politics or its licensors (as applicable). Except as expressly set forth above, nothing in these Terms and Conditions shall be deemed to grant to you or any other individual or entity any license or right in or to any copyright, trademark, trade secret, or other proprietary right, whether owned by Politics, its licensors, or any other person.
16. User Contributions and Submissions. While Politics appreciates your comments and is happy to answer questions about our products, services, and company, we generally do not accept ideas, know-how, inventions, or suggestions for products and services (“Submissions”). This is for your protection and for ours, and to avoid misunderstanding about the origin of Submissions between you and Politics.
Any Submissions, remarks, graphics, or other information provided by you by any means, including through the Services, email, a “Contact Us” form, any “Live Chat” functionality, or otherwise, is and will be non-confidential and non-proprietary, except to the extent that it contains or constitutes personal information, which is subject to the guidelines established in our Privacy Policy.
17. Accessibility. We are working to improve the accessibility and usability of the Services and want as many people as possible to be able to use them. We are in the process of enhancing the Services to support greater accessibility over time. 21. Indemnification. To the extent permitted by applicable law, you agree to indemnify and hold Politics, its partners, its licensors, and its and their affiliates, members, officers, directors, managers, partners, employees, consultants, temporary resources, agents, suppliers, providers, contractors, subcontractors, licensors, successors, transferees, and assignees harmless from and against any and all damages, liabilities, actions, causes of action, suits, claims, demands, losses, costs, and expenses (including without limitation reasonable attorneys’ fees, disbursements, and court costs, including any incurred in enforcement of this indemnification provision) arising from or in connection with (a) your use of the Services, or any Materials, content, information, or services contained, displayed, available, or accessible on or from the Services; (b) your violation of these Terms and Conditions; (c) any Submission or User Contribution provided by you to Politics; or (d) your violation of any rights of any third party.
22. Third-Party Links. The Services may provide links or references to third-party websites, mobile applications, services, or materials that are not provided by, related to, or maintained by Politics. Politics has no responsibility for the content thereof, regardless of whether the link is provided by Politics or a third party, and Politics shall not be responsible or liable for any damages or injury arising from your access to or use of that content. You should review any terms and conditions and privacy policies or statements associated with such third-party websites, applications, services, or materials before use.
The display of any link shall not and does not constitute or imply endorsement by Politics or its partners or its and their licensors of the linked website or any content therein. No judgment or warranty is made with respect to the accuracy, timeliness, or suitability of the content of any website to which the Services may link, including information on such other website regarding Politics or its partners.
23. Goods Not for Resale or Export. You represent and warrant that you are purchasing products from the Services for your own personal or household use only, and not for resale or export. You further represent and warrant that all purchases are intended for final delivery to locations within the United States, except where international shipping is expressly offered and completed through the Services.
24. Force Majeure. We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms and Conditions, for any failure or delay in our performance when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic or pandemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), restraints or delays affecting carriers, inability or delay in obtaining supplies of adequate or suitable materials, or materials, telecommunication, or power failure or outage.
25. Dispute Resolution and Governing Law. Equitable Relief. You acknowledge and agree that the terms contained in these Terms and Conditions are reasonable and necessary, and that your actual or threatened breach would give rise to irreparable harm to Politics for which monetary damages would not constitute an adequate remedy and, in addition to any and all other rights that may be available in respect of such breach or threatened breach, will entitle Politics to immediate injunctive and other equitable relief without any requirement to post bond.
Governing Law; Venue. These Terms and Conditions are governed and interpreted pursuant to the laws of the State of Louisiana, United States of America, notwithstanding any principles of conflicts of law. Politics makes no representation that Materials provided through the Services are applicable or appropriate for use in all locations. If you use the Services from other locations, you are responsible for compliance with applicable local laws. If you take legal action relating to these Terms and Conditions or your interactions with or relationship to Politics that is not subject to arbitration as provided below, you agree to file such action only in the state and federal courts located in Lafayette, Louisiana and waive any objection you may have to the venue or forum. Regardless of the governing law and forum chosen above, you may be entitled to the protection of the mandatory consumer-protection laws of your state of residence, and nothing in these Terms and Conditions deprives you of the protection of any provision of that law that cannot be waived by agreement.
Pre-Arbitration Dispute Resolution. Any controversy or claim between you and Politics arising out of or relating to these Terms and Conditions, or breach thereof, including disputes with respect to whether the subject matter of any controversy or claim is within the scope of these Terms and Conditions (a “Dispute”), will be resolved in accordance with the following process. One party must first send a written notice of the Dispute to the other party by email with a delivery receipt requested (“Notice”). Politics’s email address for Notice is contact@sneakerpolitics.mom. The Notice must describe the nature and basis of the Dispute and set forth the specific relief sought (the “Demand”). The parties shall first meet and confer, by such method as they may mutually agree, to attempt to resolve the Dispute in good faith for thirty (30) days after the Notice is received, or such further period as the parties may mutually agree. If the Dispute is not resolved by the end of such period, then either party may commence arbitration as described below.
Arbitration. If the parties are unable to resolve a Dispute through the good-faith negotiation procedure above, then you and Politics agree that such Dispute will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate Disputes includes all claims arising out of or in any way related to these Terms and Conditions and your receipt of marketing messages from Politics or its service providers, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a claim arises. YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE TERMS AND CONDITIONS, YOU AND POLITICS ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. Notwithstanding the foregoing, nothing in these Terms and Conditions will be deemed to waive, preclude, or otherwise limit the right of either party to (i) seek injunctive relief in aid of arbitration from a court of competent jurisdiction in Lafayette, Louisiana; or (ii) file suit on an individual basis in small-claims court for applicable claims. This agreement to arbitrate is mutual and binds both you and Politics. In addition, nothing in this Section waives, and this Section shall not be interpreted to waive, any right to seek public injunctive relief that cannot be waived under applicable law; any request for such public injunctive relief shall be severed from any arbitrable claims and may be brought in a court of competent jurisdiction, while all other Disputes are resolved in arbitration on an individual basis.
Arbitration Process. Unless otherwise agreed upon by the parties in writing, the arbitration will be conducted in Lafayette, Louisiana, or by video conference (at the claimant’s election), and will be governed by the American Arbitration Association’s then-current rules (the “Rules”), as may be modified by these Terms and Conditions. The Rules and filing forms are available at www.adr.com. The arbitration will have one (1) neutral arbitrator if the amount in controversy is less than one million dollars ($1,000,000) or otherwise before a panel of three (3) neutral arbitrators. The parties explicitly disclaim any applicability of the U.N. Convention on Contracts for the International Sale of Goods to these Terms and Conditions. All arbitration proceedings will be conducted in English. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement. In the event any Dispute is held not to be arbitrable, each party consents to the exclusive jurisdiction of the state or federal courts located in Lafayette, Louisiana.
Right to Opt Out. You may opt out of this arbitration agreement within thirty (30) days after first accepting these Terms and Conditions by sending written notice of your decision to opt out to contact@sneakerpolitics.mom, stating your name and the fact that you decline this arbitration agreement. Opting out will not affect any other provision of these Terms and Conditions.
Fees. If you commence arbitration in accordance with this Section, you will pay the initial filing fee in accordance with the administrator’s then-applicable fee schedule. If the arbitrator finds that either the substance of your claim or the relief sought is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the Rules. The arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award, if any, is based. Each party agrees that any such decision, and information exchanged during arbitration, will be kept confidential except as required by law or to enforce or permit limited judicial review of the award.
No Class Actions. To the fullest extent permitted by applicable law, you and Politics agree that ANY CLAIMS BROUGHT BY YOU AGAINST POLITICS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING, AND MAY NOT AWARD CLASS-WIDE RELIEF. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY RIGHT TO TRIAL BY JURY IN ANY ACTION, SUIT, CLAIM, OR PROCEEDING BROUGHT TO ENFORCE, DEFEND, OR INTERPRET ANY RIGHTS OR REMEDIES ARISING HEREUNDER OR RELATING TO OR IN CONNECTION WITH THESE TERMS AND CONDITIONS.
Enforcement. If any part of these Terms and Conditions is found to be unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions. If any portion of this Section 25 is found unenforceable, that portion will be severed and the remainder of this Section 25 will remain in force; provided, however, that if the class-action/representative-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in a court of competent jurisdiction rather than in arbitration, and all other claims shall remain subject to arbitration.
26. Assignment. You may not assign or otherwise transfer these Terms and Conditions or any rights or obligations hereunder, in whole or in part, and any such assignment in violation of these Terms and Conditions shall be null and void. The failure of Politics to exercise or enforce any right or provision set forth herein shall not constitute a waiver of such right or provision.
27. No Third-Party Beneficiaries. Except as expressly provided in Annex B with respect to Apple, these Terms and Conditions do not and are not intended to confer any rights or remedies upon any person other than you.
28. Notices. Except where applicable law requires otherwise, all notices under these Terms and Conditions will be given by email. We may provide notice to you by sending a message to the email address associated with your account or most recent order, and it is your responsibility to keep that email address current. You may provide notice to us by email to contact@sneakerpolitics.mom, which we monitor for this purpose. Notices sent by email will be effective when sent.
29. Amendments and Modifications to the Services. Politics reserves the right to make changes to the information, data, and Materials provided on the Services at any time without notice. Politics also reserves the right to modify or discontinue some or all of the Services, or any Materials contained or accessible thereon, at any time without prior notice. Politics shall in no way be held liable for any consequence that results from Politics’s decision to modify or discontinue providing the Services or any content or functionality thereof.
30. State Consumer Disclosures. California Residents. Under California Civil Code § 1789.3, California users are entitled to the following consumer-rights notice: the provider of the Services is Sneaker Politics, LLC, located at 240 Ridge Road, Unit B, Lafayette, Louisiana 70506. To file a complaint or receive further information regarding use of the Services, contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing or by telephone at (800) 952-5210.
New Jersey Residents. If you are a New Jersey consumer, the provisions of these Terms and Conditions (including the disclaimers of warranties, limitations of liability, and indemnification obligations) apply only to the extent permitted by law; no provision is intended to, and no provision shall, waive any right or remedy that cannot lawfully be waived, and any provision that a court of competent jurisdiction determines to be unenforceable as to New Jersey consumers shall not apply to you.
All U.S. States. The disclaimers of warranties, limitations and exclusions of liability, indemnification obligations, and waivers in these Terms and Conditions apply only to the fullest extent permitted by the law of your state of residence. Nothing in these Terms and Conditions waives, limits, disclaims, or excludes any right, warranty, remedy, or protection that the law of your state does not permit to be waived, limited, disclaimed, or excluded, and no provision applies to you to the extent it is prohibited by the mandatory consumer-protection law of your state. Because some states do not allow certain disclaimers, limitations, or exclusions, some of the above provisions may not apply to you, and you may have additional rights under the law of your state. The California notice above applies only to California residents; other state-specific notices apply only to residents of the state named.
31. Miscellaneous. You guarantee that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
Politics expressly reserves the right to monitor any and all use of the Services. Politics also reserves the right to investigate and take legal action against any illegal and/or unauthorized use of the Services and/or Materials. Politics’s decision not to pursue legal action for any violation of these Terms and Conditions shall not be construed as a waiver of any provision or of any of Politics’s legal rights.
These Terms and Conditions constitute the entire agreement between you and Politics with respect to the subject matter hereof and, together with our Privacy Policy and order confirmation, supersede all prior or contemporaneous agreements, understandings, and representations, whether written, oral, or otherwise.

Annex A: Mobile Message Service Terms and Conditions
Your use of Politics’s SMS/text messaging service (the “SMS Service”) constitutes your agreement to these terms and conditions (these “SMS Terms”). We may modify or cancel the SMS Service or any of its features at any time, without notice. To the extent permitted by applicable law, we may also modify these SMS Terms at any time, and your continued use of the SMS Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to participate in the SMS Service, you agree to receive recurring SMS/text messages from and on behalf of Politics through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. From time to time, we may send you promotional messages about product launches, promotions, markdowns, partnership announcements, and other marketing offers (for example, cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Politics. Your participation is completely voluntary.
We do not charge for the SMS Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details.
You may opt out of the SMS Service at any time. Text the single keyword command STOP to 79376 to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. If you have subscribed to other mobile message programs from Politics and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs. For SMS Service support, text HELP to 79376, or email contact@sneakerpolitics.mom.
We may change any short code or telephone number we use to operate the SMS Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, that you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the SMS Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
Without limiting the generality of the limitation-of-liability provision set forth above, to the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS Service, any errors in such information, and/or any action you may or may not take in reliance on the information or SMS Service.

Annex B: Apple iOS Applications
The following additional terms apply to your use of the Services through Apple, Inc. (“Apple”) iOS mobile application software programs purchased or made available through the App Store (“App Services”), and are in addition to the Terms and Conditions above, which are incorporated herein by reference.
The Terms and Conditions are entered into and binding between you and Politics, and not Apple, and as between Politics and Apple, Politics is responsible for the App Services and their content, subject to the limitations and disclaimers contained in the Terms and Conditions. Apple has no obligation whatsoever to furnish any maintenance and support with respect to the App Services. Apple is not responsible for addressing any claims by you or any third party relating to the App Services, including but not limited to: (a) product-liability claims; (b) any claim that the App Services fail to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation. In the event of any third-party claim that the App Services or your possession and use of the App Services infringes that third party’s intellectual property rights, Politics, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You are only permitted to use the App Services on any Apple-branded products that you own or control, and as permitted by the App Store Terms of Service, except that the App Services may be accessed, acquired, and used by other accounts associated with the purchaser via Apple’s Family Sharing functionality or volume purchasing.
Politics is providing the App Services AS-IS and disclaims all warranties of any kind, express or implied, as fully set forth in the Terms and Conditions. To the extent any warranty is nevertheless adjudged to exist with respect to the App Services and is not effectively disclaimed by the Terms and Conditions, Politics, and not Apple, is responsible for any such warranty. Apple’s sole warranty obligation in such circumstances is limited to refunding the App Store purchase price of the particular App Services, and, to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App Services, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty shall be Politics’s sole responsibility.
You must comply with any applicable terms of third-party agreements relating to your use of the App Services.
You acknowledge that Apple and its subsidiaries are third-party beneficiaries of the Terms and Conditions with respect to the App Services, and that, upon your acceptance of the Terms and Conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms and Conditions against you with respect to the App Services as a third-party beneficiary thereof.
Annex C: Google Play (Android) Applications
The following additional terms apply to your use of the Services through the Android mobile application software program made available through the Google Play store operated by Google LLC (“Google”) (the “Android App Services”), and are in addition to the Terms and Conditions above, which are incorporated herein by reference. If there is any conflict between this Annex C and the other provisions of the Terms and Conditions with respect to the Android App Services, this Annex C controls as to the Android App Services.
The Terms and Conditions are entered into and binding between you and Politics, and not Google. As between Politics and Google, Politics is solely responsible for the Android App Services and their content, subject to the limitations and disclaimers contained in the Terms and Conditions. Google has no obligation whatsoever to furnish any maintenance or support services with respect to the Android App Services, and Google is not responsible for addressing any claims by you or any third party relating to the Android App Services or your possession or use of them, including but not limited to: (a) product-liability claims; (b) any claim that the Android App Services fail to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. In the event of any third-party claim that the Android App Services or your possession and use of the Android App Services infringe that third party's intellectual property rights, Politics, and not Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Your download, installation, access, and use of the Android App Services must comply with the then-current Google Play Terms of Service and any other applicable Google policies or agreements, including the Google Play usage rules. You are responsible for acquiring and maintaining any equipment, device, and third-party services (including a compatible Android device and internet or mobile data connectivity) necessary to access and use the Android App Services, and for any fees charged by your wireless carrier or other third parties in connection with such use.
Politics grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Android App Services on an Android-powered device that you own or control, solely for your personal and non-commercial purposes and as permitted by the Google Play Terms of Service. All other rights are reserved to Politics and its licensors, as set forth in the Terms and Conditions.
Politics is providing the Android App Services on an “AS IS” and “AS AVAILABLE” basis and disclaims all warranties of any kind, whether express or implied, as fully set forth in the Terms and Conditions. To the extent any warranty is nevertheless adjudged to exist with respect to the Android App Services and is not effectively disclaimed by the Terms and Conditions, Politics, and not Google, will be solely responsible for any such warranty and for any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any such warranty.
You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Google, and Google’s subsidiaries, are not a party to the Terms and Conditions and are not responsible for the Android App Services. Google is not providing any warranty for the Android App Services and, except as may be required under the Google Play Terms of Service, is not responsible for providing any support, maintenance, refunds, or other services in connection with the Android App Services.
You must comply with any applicable terms of any third-party agreement that applies to you when using the Android App Services.
